Courts cannot examine intimate moments of couples unless extreme cruelty is involved: Allahabad High Court

A division bench Saumitra Dayal Singh and justice Donadi Ramesh made this observation while dealing with an appeal filed by a woman against the grant of divorce in proceedings initiated by her husband.

The bench emphasized that the issue of different preferences of the husband in intimate moments, compared to those desired by the wife, must be better resolved by the couple without any intervention from the Court.

What are the personal tastes, preferences and habits, the acts that one party to a marriage may feel inclined to practice, perform and desire their partner to participate in, within the confines of that relationship which also involves intimate moments is not for the Court to explore or examine unless they involve acts of extreme cruelty and/or depravity ex facie“, declared the Court
